Processing of your case

Every year, we process more than 6,000 cases. The time it takes to process a case varies greatly.

Receipt of claim

When we receive your claim, we review it to ensure that we have all of the information we require.

Materials from the hospital

We then send the claim to the place of treatment where the injury occurred. This could be a hospital, a practising physician, specialist, etc. They must then also write a report and send journal materials to us.

If you have been treated at multiple locations, we collect information from all of these locations.
It typically takes 1-2 months before we have the journal materials and the report from the place of treatment. We send you a copy of this report and you are given the opportunity to submit remarks regarding the report.

A decision is made in the case

When we have the materials required to assess your case, our lawyers begin the legal processing of the case. They will examine whether an injury has occurred and whether there are grounds for awarding compensation.
Your case will typically be assessed at a so-called doctor meeting. The doctor receives the journal materials and a series of questions from the lawyer and prepares for the meeting in advance. The cases are then discussed by the lawyers and doctors at the meeting. Sometimes, the doctor requests additional information, e.g. a doctor statement.

On average, it takes 8 months from the time we receive your claim until we make a decision in the case. Some cases can be decided quicker and others take longer.

Calculation of compensation

If you are entitled to compensation, we will then begin the process of calculating your compensation. This calculation is made in accordance with The Danish Liability for Damages Act. We often request additional information for this process, e.g. receipts for drugs, transport expenses or a doctor statement.

If you are not satisfied

If you disagree with our decision, you can appeal to the Patient Injury Appeals Board. The appeals board is empowered to increase a compensation award, reduce a compensation award, or decide to revoke a paid compensation award, which must then be paid back by the patient.
